But no permanent appt can be made without a fresh warrant, which seems to produce rather an anomalous result, since there is nothing to prevent a person from holding office for an indefinite period.

The question is, when Mr May became Col. Sec. & the warrant apptg him M. L. C. thereby ceased to have effect, was there a vacant seat in the Ccl. to which it was competent for the Gov to appt provisionally? I think it was all right owing to the words "vacant" in art 14 of the further Instructions of Jan '88. If so, no action is required by me in regard to his appt.
1895 authorised his appt only for so long as he held the offices of Capt Supt of Police, & I do not think any question can be raised as to whether his seat became vacant the moment he became entitled to an Ex-officio seat as Colonial Secretary.
